1. Purpose
This Anti-Fraud Policy ("Policy") is incorporated into and forms part of the Master Service Agreement ("MSA") between Zenwork Inc ("Company") and the customer ("Customer"). This Policy is established to prevent, detect, and address fraudulent activities related to the use of Zenwork’s services.

2. Scope
This Anti-Fraud Policy applies to all Zenwork products, services, and programs as outlined in the applicable Terms and Conditions. It operates in conjunction with Zenwork’s existing agreements and policies, ensuring compliance with the fraud prevention measures established therein.

3. Fraudulent and Prohibited Activities
Customers shall not engage in any fraudulent, deceptive, or unauthorized activities, including but not limited to misrepresentation of intended use, identity, falsification or manipulation of documents and records, unauthorized access or use of accounts, misuse of payment methods, submission of false or misleading tax information, or any attempt to evade legal, financial, or compliance obligations. Fraudulent activities may also include but are not limited to abuse of promotions, unauthorized chargebacks, or any attempt to gain an unfair advantage through deceptive means. Additionally, any fraudulent conduct involving the submission, publication, or transmission of false material, as outlined in section Q in Zenwork’s Terms & Conditions, shall be subject to this Policy. Zenwork retains sole discretion to determine what constitutes fraudulent, deceptive, or unauthorized activity and reserves the right to investigate and take appropriate measures to prevent and mitigate fraud.

4. Enforcement & Disciplinary Actions

4.1 Investigation Procedures

Upon detecting suspicious activity, Zenwork may take appropriate measures, including but not limited to:

  • Temporarily restricting the Customer’s account access pending further review.
  • Requesting additional identity verification and supporting documentation as needed.
  • Conducting a thorough investigation and issuing a determination of action within a reasonable timeframe.
  • Collaborating with relevant authorities, including the IRS, SSA and other law enforcement agencies, to authenticate filings and provide information as required.
  • Customers agree to fully cooperate with Zenwork’s investigation process by providing requested documentation and responding to inquiries in a timely manner. Failure to comply may result in account suspension or termination.

4.2 Appeals & Review Process

Customer whose account has been identified for suspected fraud may:

  • Submit a formal appeal within seven (7) days of receiving a fraud notice from Zenwork.
  • Provide relevant documentation substantiating the legitimacy of their tax return.
  • Receive a final determination from Zenwork’s fraud prevention team within fourteen (14) business days, subject to the complexity of the investigation. If additional time is required, Zenwork will notify the Customer accordingly.
  • If the appeal is denied, the Customer’s account may remain permanently suspended, and their information may be forwarded to relevant authorities.

4.3 Legal Consequences

Customers found engaging in fraudulent activities may be subject to the following penalties:

  • Permanent termination of their Zenwork account upon confirmation of fraud.
  • Reporting to IRS Criminal Investigation (IRS-CI) SSA and other relevant law enforcement agencies as necessary.
  • Potential civil or criminal legal actions, including fines and penalties, as determined by regulatory authorities.

5. Steps to Take If Fraud is Suspected

If the Customer becomes aware of any fraudulent activity or suspicious behavior, they must report such incidents immediately to the Zenwork at [email protected]. Zenwork will assess the situation and may provide guidance on appropriate next steps based on the nature of the suspected fraud and confidentiality requirements.

6. Miscellaneous

  • Any fees incurred in connection with fraudulent transactions are strictly non-refundable. Zenwork retains the right to withhold such payments to safeguard the integrity of its platform and prevent misuse of services.
  • Zenwork reserves the right to modify, amend, or terminate this Policy at its sole discretion without prior notice. Continued use of Zenwork’s services constitutes acceptance of the updated Policy.
  • Zenwork shall maintain records of fraud reports and resolutions indefinitely for compliance and audit purposes.
  • In case of any conflict between this Policy and any other agreement between the Customer and Zenwork, the terms of this Policy shall prevail to the extent of the inconsistency.
