Wages Over $1,500: If you paid any of your employees at least $1,500 during the standard calendar year, you’re required to file Form 940.
20 or More Weeks of Employment: If you had any employees, whether they’re temporary, part-time, or full-time, working for you during 20 or more weeks in the year, you also need to file Form 940. These 20 weeks don’t have to be consecutive; they can be spread out throughout the year.
Remember, even if you usually have employees but didn’t make any payments to them during a specific calendar year, you still have to file Form 940. Just make sure to indicate on the form that no payments were made during that time.
So, if you meet either of these two conditions, it’s time to fill out Form 940 to fulfill your tax obligations.
